The Supreme Court Nomination
Well, here we go again. The liberal left decrying the prospects of a
conservative strict constructionist on the Supreme Court.
They "warn" that a move to the "right" on the court will set
back their so called gains over the last decades. What gains?
Abortion, homosexual rights, loss of property rights, marginalization of
religious expression i.e. ten commandments ruling, abridging the right of public
prayer?
All these "gains" struck at the moral foundation of the Declaration of
Independence and the Constitution.
Stare Decisis
Now come the hypocrisy and the irony. The left cries out for protection of
the principle of Stare Decisis i.e. maintain previous liberal court rulings
including some referenced above.
But wait a minute. What about the liberal view of the constitution being a
"living, breathing document?"
So here we are. When liberals want to change the foundation of the
constitution through judicial fiat then it is "a living and breathing
document." In reality this position says that "the
constitution says what we want it to say."
Once the liberal positions are enacted by Supreme Court ruling suddenly liberals
flip sides waving the banner of stare decisis. They go from the "rubber
band man" to "crazy glue" in regard to the constitution and
supreme court decisions.
Politics and the Supreme Court
As I recall, I don't remember political operatives trying to manipulate and
"road block" the nominations of such liberals as Ginsberg, Breyer,
etc. Rather, it has been the liberal left who have asserted politics into
the process. Why?
It is the liberal left who rely on the
judiciary to advance their agenda because they can't do it through the electoral
process. Their support is minimal.
Abortion on demand for any reason is
rejected by nearly 80%. Partial birth abortion is rejected by nearly 90%.
In the last election several states had initiatives rejecting homosexuality.
They passed overwhelmingly by 75-90%. Nearly 90% of Americans support
prayer in the schools.
Therefore we can understand the
politicization of the judicial nomination process of the Supreme Court, the
Appellate Courts etc. It is the liberals last and only hope.
The Mainstream
From the perspective of the left, even the mainstream appears extreme. So
what is the left's definition of "mainstream"?
Since they view all politics from within
the depth of extreme liberalism then their view of "mainstream" is in
context of that perspective rather than a panoramic view of the entire
electorate.
However, I can understand their definitions
because the real mainstream of America rejects their political agenda. The
left has built their house and view all politics through that perspective.
Upcoming Decisions
Many cases affecting moral issues will come before the court. One, of
course, is the abortion issue. Previously, Mr. Nassif wrote a press
release about the constitutionality of abortion. It is reprinted below.
Abortion, Declaration of Independence and the Constitution

Since God, the Benefactor of our civil rights, declares that
a child is a person "endowed by their Creator with certain inalienable
rights...," we need examine which constitutional
rights are violated when a child is aborted.
A. Declaration of Independence: A child is "...endowed by their
creator with certain unalienable rights, among them life, liberty and the
pursuit of happiness...." Thus abortion
denies the child this most basic of their God-given rights.
B. 6th Amendment in essence states that "...the accused shall enjoy
the right to a speedy and public trial...to be confronted with the witnesses
against him, to have compulsory process for obtaining witnesses in his
favor..."
Abortion imposes the penalty for a capital crime upon an unborn child. The child
is brutally executed without charge and without the protections of this
amendment.
C. 8th Amendment: This guarantees protection against "...cruel and
unusual punishments..."
First, the child is not guilty of anything worthy of punishment. Secondly, the
unwarranted punishment of abortion is, by it's nature "cruel and
unusual."
Nowhere in America is the death penalty imposed by dismemberment in tearing the
person apart until dead. Nowhere in America is the death penalty imposed which
burns a person to death.
Abortion is an execution worse than that given to mass murderers. Many convicted
murderers are permitted to live. Not so with an unborn child who’s guilty
being alive.
D. 14 Amendment
This amendment guarantees the protection of due process.
"...No state shall make or enforce any law which shall abridge the
privileges or immunities of citizens of the United States, nor shall any state
deprive any person of life,
liberty, or property, without due process of law, nor deny any person within its
jurisdiction the equal protection of the laws."
To destroy an unborn child is a clear denial of their right to "due
process" and, contrary to the provisions of this amendment abortion is a
denial of the unborn child's right to "...equal protection of the
laws." which includes the protection of "life, liberty and the pursuit
of happiness.", the core of our national and individual existence
What to Do?
Call your U.S. Senator and make your voice known. Request them to give
Alito an up or down vote in the full Senate
